Commentary

Concerns Regarding the New 12(9) Class of Licence, Micheal Loberg

The CZ and SAN rifles were previously non-restricted until the RCMP unilaterally declared them to be prohibited. The Conservative government responded to citizen outrage and (among other things) amended the "Regulations Prescribing Certain Firearms and Other Weapons, Components and Parts of Weapons, Accessories, Cartridge Magazines, Ammunition and Projectiles as Prohibited, Restricted or Non-Restricted" to force these firearms back to being non-restricted by regulation (the “Non-restricted Amendment”).

Bill C-71 will remove the Non-restricted Amendment, putting the CZ and SAN rifles back into the prohibited category.

Bill C-71 also creates “grandfathering” provisions for these specific rifles. In particular:

  1. The CZ rifles listed in the new section 12(11) of the Firearms Act will be grandfathered by a new class of prohibited licence under section 12(10) of the Firearms Act (the “12(10) Licence”).
  2. The SAN rifles listed in the new section 12(14) of the Firearms Act will be grandfathered by a new class of prohibited licence under section 12(13) of the Firearms Act (the “12(13) Licence”).
  3. Both the 12(10) Licence and the 12(13) Licence categories of firearms are not expressly prohibited from being granted ATTs for shooting purposes, however whether or not the CFOs will issue ATTs for these firearms as a matter of their discretion remains to be seen.

As a separate matter, and it is a separate matter from the CZ and SAN rifles treatment, a new “mystery” class of prohibited licence is created under section 12(9) of the Firearms Act (the “12(9) Licence”). This class of licence authorizes an individual to possess prohibited firearms of a “prescribed class” under certain conditions, but nowhere is it yet disclosed as to what is going to be written into that “prescribed class” by way of future regulation.

Because the newly-created 12(9) Licence class is unrelated to the other amendments to the Firearms Act or the firearms specifically dealt with by these amendments, the fact that it exists is clear evidence of an intention that the RCMP and the government have the ability to grandfather further classes of newly-prohibited firearms.

As to the ATTs for the affected guns, under the proposed amendments:

  1. Restricted-class ATTs for target shooting are still automatic under section 19(2.1);
  2. Prohibited-class 12(6.1) firearms (short and small pistols) for target shooting are automatic under section 19(2.3);
  3. Other prohibited-class firearms are the subject of discretionary ATTs under section 19(1), modified by subsections 1.1 and 2 as follows:
  4. Subsections 1.1 requires that (subject to an exception) if a discretionary ATT is granted for target shooting purposes for any prohibited firearms, it must include all ranges in the province, a “whole province” requirement. The exception is for 12(9), 12(10) and 12(13) licences, which are excluded from this whole province requirement;
  5. Subsection 2 eliminates target shooting as an option for an ATT for prohibited firearms except for:
  6. Prohibited class 12(6.1) firearms (short and small pistols); and
  7. 12(9), 12(10) and 12(13) licences.

Accordingly, CZ and SAN rifles can notionally still be the subject of discretionary ATTs. Whether or not ATT’s will actually be granted remains to be seen.

Prohibited class 12(6.1) firearms will continue to be legal for, and ATTs issued regarding, target shooting.

This leaves the newly-created 12(9) Licence class, which being in respect of an unknown and potentially undecided list of prohibited-class firearms, may have a discretionary ATT issued for target shooting, but without the automatic “whole province” requirement.

Unfortunately, the Liberal government and the RCMP have not disclosed to us what it is that they intend to newly make into a prohibited-class of firearm, so as to populate this newly created 12(9) Licence class.

Heidi Rathjen, a gun control activist and survivor of the 1989 Polytechnique massacre, said she felt "utter disappointment" after reviewing the proposed law, which she said offered "lots of concessions to the gun lobby."

"Our impression when we look at the details is that it was specifically designed to look like they're doing something, but to minimize the ire of the gun lobby as much as possible," Rathjen, a spokesperson for the gun control group Poly Remembers, told CBC Montreal's Homerun.

"Once you leave the store, you could sell them to anybody now and not leave a trace, which makes it really easy to feed into the black market," she said.

"We want sales to be recorded. We want police to have access to them, and we want private sales to be included."

      • 3rd event is a round of Trap. 25 rnds of shotgun, your choice of gage.
      • Finally we’ll end the day with a fun rifle and pistol shoot. Bring whatever you want to shoot. Distances between 100-200 on the rifle range. 18m on the pistol range on steel plate rack, dueling tree and hostage target.
    • All three events will take place at the Restigouche Gun Club in Balmoral NB.
    • BBQ provided by Smoke on the Water. Smoke Meat, sides and drinks.

VALUED CUSTOMERS- HEX MAG UPDATE:

After nearly two months of working with the RCMP lab on design concerns with the 10/30 Hex Mag, we finally reached a conclusion. The 10 round models with internal limitation and shortened spring have been classified as prohibited devices in their current configuration.

The RCMP have clarified that:

"A rivet applied to the Hexmag magazine casing which prevents more than five cartridges to be contained in the magazine would meet the requirements of the magazine regulations ..."

We fully recognize that a 5 round limitation was not what our customers were paying for so we have created a separate RETURN POLICY specifically for these magazines for anyone not enthused about riveting their kit.

Requests for returns will be accepted until April 13th. Because we are dealing with prohibited devices, we need to have a closing date whereby we have given ample time to correct the problem.

Any requests for returns can be directed to CustomerService@BartonsBigCountry.ca

Our Customer Service Reps will begin compiling return requests immediately and begin replying with return packages on Monday, March 19th for anyone wishing to take advantage of that program.

GUNTER: Rural communities under the gun

I don’t mean that if the Libs can just do something about getting guns under control, they will reduce the rural crime rate, which has risen by more than 20% in many rural parts of the country over the past five years.

Nope. From that aspect, past Liberal gun control measures have actually made rural crime worse.

Past gun controls — such as the firearms registry — have given criminals the impression there are fewer law-abiding citizens with guns out. And that has caused crime to rise because the bad guys have more confidence they will not meet armed civilians while out burglarizing innocent Canadians.

Whatever new controls the Trudeau government brings in, perhaps as early as this spring, are most likely only going to make rural crime worse.

 

Alleged criminals are often treated by police, prosecutors, judges and politicians with more respect and compassion than self-defending landowners. (And don’t think criminals haven’t sensed that, too, and increased their criminal activities as a result.)

Conservative Leader Andrew Scheer says he wants to create a firearms ombudsman to advocate for gun owners and that the RCMP should no longer have the power to reclassify guns – a proposal being dismissed as “nonsense” by the country’s former top cop.

 

Mr. Scheer’s proposals include a sweeping pledge to review the Criminal Code and repeal all federal regulations on gun ownership, usage and transportation, which do not “ensure that Canada’s firearms laws respect the rights of honest firearms owners, recognize the fact that hunting and sports shooting are an important part of Canadian culture and history, and empower police to concentrate on real criminals who are a threat to the public.”

 

But former RCMP commissioner Bob Paulson said one of Mr. Scheer’s promises, which takes aim at the Mounties for reclassifying guns based on aesthetics, is “nonsense, nonsense and a little bit more nonsense.”

 

“There is a rabid firearms lobby that has their hooks into the Conservatives, and they’re aggressive, and the only way that, in my view, the political folks can keep them at bay, is to blame the RCMP,” Mr. Paulson, who retired last June after 32 years in the force, told The Globe.

 

“In truth, the elected officials have all the power in the world right now. It’s not a discretionary call that the RCMP make, it is the application of the laws that those elected officials make.”

   As a Father of four, tax payer, and firearms owner I appreciate the work you guys do and the show you put on each week.  Holding government accountable is a fundamental democratic responsibility, especially when that same government chooses not to do so itself.  

   I do believe that legal firearms owners are the current whipping boy (sorry didn't mean to assume gender, whipping person) for the failing liberal government.

   I found it refreshing in your host's comments regarding the breakdown of family as one of the chief contributors to society's current status.  Not many people would acknowledge that. To find the opinion on the fringes of the interwebs is encouraging.

  Your host (Main host?) Andrew mentioned an author who is associated with the libertarian movement.  The host mentioned the author and the idea of non-aggression, I was hoping to get the name of that person as well as the title of the book.  I know it was mentioned in the last episode, but the name escapes me.

I never miss an episode and love the show. Would be great if they can just come out and say they don’t have Rod Giltaca booked for an interview. Started at the oldest i could get on itunes(ep 20) and at 53 now. loving it.  I heard mention on one of those episodes about a manual reload setup and i was curious if you have an equipment list available for an affordable 556/9mm reloading setup

Also, I appreciate the message you guys are spreading and I have mentioned this podcast to every person I come across at work (on both sides of the spectrum) and two are now going for their unrestricted 2 weeks from now
